Should I do asset search on him?

I just won a law suit against a guy whom fraud my money. Unfortunately, his house got foreclosure before the law suit ended and he does not have a job either. He is doing Forex trading for a living. I would appreciate your suggestion on how to get my money back. I do not know where he is hiding his asset. Will an asset search help in this case? If so, are there any reliable firms/companies for asset searching? Or any other options? It will be more helpful if you have similar experience. Thanks a lot.

  1. His tax records should be available online.
  2. Judges can do a Debtors Exam, to look for hidden assets. You can search public county recorders records for other homes that he may own or be in title to. Some larger professional collection agencies have access to credit reports etc. They can also report the debt on the individual's credit report. Most will charge a percentage of the money recovered. You can file a Certificate of Judgment, that basically becomes a lien on property he owns. Depending on your state, those are good for 5 to 10 years, but it only applies to the real estate he owns at the time of filing. Your best bet is to simply contact your lawyer to see what steps he suggests. Different states have different laws so its hard to give percise info for individual states.
  3. You have a right to get a credit report on him as the permissible purpose of a report can be credit extension, collections, or location information. Go to the local Credit Bureau with a copy of the Court Procedures showing you have won, give the Bureau his name, social security number and address you know of. A credit report will give you a clue if he has assets or you are putting money down a rat hole. You are learning that a Court Judgment means nothing at times if a rat is involved.
